SECTION 4: Protection of non-users

 


Government and operators are mutually mandated to ensure every individual or entity is entitled to have no relationship with the system whatsoever if that is their wish.

 

 

4.1 there is no constraint on any alternative form of commerce online or off

 

(a)    the system operates with unique benefits, but other than not being awarded those benefits, there are no constraints on any other forms of commerce that are designed to detract from their ability to compete with the system

(b)   commitments in this section can not be phased

 

 

4.2 no one is to be compelled to use the system 

 

(a)    government has a duty to ensure all roles of the citizen, in terms of relationship with the state, can be fulfilled without registering with or using the system

(b)   it is acceptable to offer rebates to encourage entities or individuals to, for example, file their tax returns through the system but it can not be made compulsory to file this way even for users

(c)    clearly employers are entitled to compel their employees to use the system as a condition of employment as they already do with a range of software services, however the employee is entitled to demand their identity be soley linked to the employer and there is either (a) no personal usage of the system by the individual or (b) their personal identity is kept entirely separate from their usage as an employee

(d)   commitments in this section can not be phased

 

 

4.3 warnings of expansion

 

As the system matures and its sectors interlock its arrival into a new sector is likely to be highly disruptive for sellers, buyers and existing middlemen. It must make its plans clear so everyone can plan accordingly.

 

(a)    individuals and entities who choose to sell outside of the system are entitled to warning of the system’s expansion plans. It is recommended that (i) operators must give at least 6 month’s warning of a new market sector they intend to start serving or of significantly improved capabilities to be launched in an existing sector (ii) to allow some flexibility in finding franchisees and preparing new technology some intended launches on the list may legitimately not occur, to avoid operators publishing a list of every conceivable sector as a way of avoiding their obligations to non users they are in breach of their mandate if they subsequently launch less than perhaps 80% of the sectors listed. (b)   commitments in this section can not be phased

 

 

4.4 intrusive marketing to non-users is not permitted

 

Operators are entitled to purchase advertising space to promote the system to people who aren’t using it. They are not allowed to inconvenience those people.

 

(a)    operators are not permitted to maintain any form of register of individuals who are not users.

(b)   there is to be no direct approaches to individuals who are non users of the system by operators, no spam or direct mail. Corporate non-users can off course be targeted.
